Generally, when engaging a solicitor at Burke Elphick & Mead to advise in relation to a claim for compensation (damages) arising from a car accident, workplace injury or an injury in a public place, legal costs are not payable until the successful conclusion of the claim. This could be at settlement with the insurance company or at a court hearing.

As required by the Legal Profession Act, we are required to enter into a costs agreement (fee disclosure) with our clients. Generally, the terms of that agreement are that legal costs are not payable until the successful conclusion of the claim. It should be noted that as disbursements, such as medical report fees, subpoena fees and court filing fees, are classified as the costs of litigation (not professional costs) we ask our clients to pay these expenses.

However, these expenses (or disbursements) are generally recovered in full on the successful conclusion of one?s claim.
